Liability and Warranty

GeoRide undertakes to use its best efforts to provide the Services with diligence and in accordance with best practice, it being specified that it is bound by a best-efforts obligation, to the exclusion of any obligation of result, which the user expressly acknowledges and accepts.


Its liability is exclusively limited to the provision of the services in accordance with the terms described herein, to the exclusion of any other service. The User further acknowledges and accepts that the services are provided as is, without any warranty of any kind, express or implied.


In particular, GeoRide does not guarantee that:
the Services, the product and the application, which are subject to constant research aimed in particular at improving their performance and development, will be totally free of errors, faults or defects;

the Services, being standard and in no way offered solely for the User based on their own personal constraints, will specifically meet the User's needs and expectations;

the application will operate without interruption, GeoRide reserving the right to temporarily interrupt access to the Application for maintenance reasons, and in no case being liable for disruptions or failures of the internet network or the telecommunications network and the availability of GeoRide's servers, and more generally those originating in circumstances beyond its control or resulting from force majeure;
the GPS positioning of the product and the application and its effectiveness, since it is provided "as is" by a subcontractor and without any warranty of any kind.

The fall detection of the product and the application will operate without interruption, GeoRide not being liable for disruptions or failures of the internet network or the telecommunications network, GSM, GPS and the availability of GeoRide's servers

The connected alarm of the product and the application will operate without interruption, GeoRide not being liable for disruptions or failures of the internet network or the telecommunications network, GSM, GPS and the availability of GeoRide's servers

The User acknowledges and accepts that GeoRide's liability may furthermore not be engaged if the performance of the services is incomplete and/or impossible in the following cases:
if the User refuses to grant GeoRide access to the receipt of notifications or to the contact list, which are essential to the proper functioning of the Service;

in the event that the User's mobile phone is damaged at the time of performance of the services, for whatever reason, under conditions making the performance of said Services impossible or partially impossible;

if the Application does not work on the User's mobile phone, for whatever reason.

GeoRide cannot be held liable in the event of:
Damage to the vehicle and its parts or to the GeoRide device following incorrect installation or any use not in accordance with the instructions contained in the user guide found in the application.

Injury, burns or any other harm to persons caused during installation if the safety measures presented in the installation guide have not been observed.

Accident while the device is in operation if the safety warnings have not been observed.

2-Year Limited Warranty for the GeoRide device
The GeoRide two-year limited warranty is a commercial manufacturer's warranty offered by GeoRide. It confers rights that are different from those you may have under the law. Consequently, the warranty is in addition to the rights conferred by law, rather than replacing them, as described below.

RIGHTS GRANTED BY THE STATUTORY GUARANTEE
GeoRide is in all cases liable under the applicable statutory guarantee and, in particular, GeoRide is liable for any lack of conformity as stipulated in Articles L. 211-4 et seq. and for any hidden defect as stipulated in Articles 1641 et seq. of the French Civil Code.
As regards the guarantee of conformity under Article L. 211-4 of the French Consumer Code: "The seller is required to deliver goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation where the latter was made their responsibility under the contract or was carried out under their responsibility."
Under Article L. 211-5 of the French Consumer Code: "To be in conformity with the contract, the goods must:
1° Be fit for the purpose usually expected of similar goods and, where applicable:
correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model;
have the qualities that a buyer may legitimately expect in view of the public statements made by the seller, by the manufacturer or by their representative, in particular in advertising or labelling;
2° Or have the characteristics defined by mutual agreement between the parties or be fit for any special use sought by the buyer, brought to the seller's attention and accepted by the latter."
Article L. 211-12 of the French Consumer Code: "The action resulting from the lack of conformity is time-barred two years after delivery of the goods."
Article L211-16 of the French Consumer Code: "Where the buyer asks the seller, during the course of the commercial guarantee granted to them at the time of the acquisition or repair of movable goods, for a restoration covered by the guarantee, any immobilisation period of at least seven days is added to the remaining duration of the guarantee. This period runs from the buyer's request for intervention or from the time the goods in question are made available for repair, if this is later than the request for intervention."
Concerning the guarantee against hidden defects, under Article 1641 of the French Civil Code: "The seller is bound by a guarantee against hidden defects in the item sold which render it unfit for the use for which it is intended, or which so diminish that use that the buyer would not have acquired it, or would only have paid a lower price for it, had they known of them." Under Article 1648, first paragraph, of the French Civil Code: "The action resulting from redhibitory defects must be brought by the buyer within two years of the discovery of the defect."


WHAT DOES THIS WARRANTY COVER?
GeoRide warrants the brand's hardware products and accessories contained in the original packaging against material and manufacturing defects when used in accordance with the user manuals.
Please note: all warranty claims will be processed in accordance with the provisions set out in this warranty document.

WHAT DOES THIS WARRANTY NOT COVER?
This warranty does not apply:
(a) to consumable parts, such as batteries or protective coatings designed to wear out over time, unless the damage is due to a defect in materials or workmanship;
(b) to cosmetic damage, including but not limited to scratches, scuffs or broken plastic elements of the ports, unless the damage is due to a defect in materials or workmanship;
(c) to damage caused by use with a third-party component or product that does not meet the product's specifications;
(d) to damage caused by an accident, abuse, misuse, exposure to liquid, fire, earthquake or any other external cause;
(e) to damage caused by use of the product not in accordance with the guidelines indicated in the user guide;
(f) to damage caused by any work (including upgrades and extensions) carried out by anyone who is not a member of GeoRide staff;
(g) to a product that has been modified in a way that alters its functionality or capabilities without GeoRide's written authorisation;
(h) to defects resulting from normal wear and tear or the normal ageing of the product;

YOUR RESPONSIBILITIES
Do not attempt to open the device. Opening the product or removing the protective covers may cause damage that is not covered by this warranty. Only the GeoRide team is authorised to carry out repairs on this product.

WHAT GEORIDE DOES IN THE EVENT OF A WARRANTY CLAIM
If, during the warranty period, you submit a claim to GeoRide under this warranty, GeoRide may:
repair the product using new parts or used parts equivalent to new parts in terms of performance and reliability, or
replace the product with the same model (or, with your consent, a product offering similar features), made up of new parts and/or reconditioned parts of equivalent effectiveness and reliability, or
refund you the sale price in exchange for the return of your product.

If a part or product is replaced or a refund is granted, any replacement product will become your property and the refunded or replaced product will belong to GeoRide.

HOW TO OBTAIN WARRANTY SERVICE
To obtain warranty service, please submit a request using the contact form available on the GeoRide website: georide.fr

GeoRide will send you prepaid shipping labels and, where applicable, packaging material and instructions explaining how to pack and address your product, so that you can ship it. Once the repair is complete, GeoRide will return the product to you. GeoRide will bear the shipping costs to and from your location provided that the instructions regarding the method of packing and shipping the product are followed.

LIMITATION OF LIABILITY
Except for the rights granted to you by consumer protection law, as specified at the beginning of this document, all warranties and other conditions not stipulated in this warranty document (whether oral or written) are, to the fullest extent permitted by law, excluded from the GeoRide two-year limited warranty.
In no event shall GeoRide be liable for the following:
loss of profits; or
loss of business; or
reduction in goodwill and/or other similar losses; or
loss of anticipated savings; or
loss of property; or
loss of contracts; or
loss of use; or
loss of or damage to data or information; or
any special, indirect, consequential or purely economic damage, loss, expense, charge or cost.

GENERAL
No reseller, employee or agent of GeoRide is authorised to make any modification, extension or addition whatsoever to this warranty. If any condition is held to be illegal or unenforceable by law, it will be excluded from the warranty and the legality or enforceability of the other conditions will not be affected.
This warranty is governed by and interpreted in accordance with the laws of the country in which the product was purchased.

The optional 130 dB anti-theft siren is prohibited for use in urban areas or close to people. The supplied 110 dB anti-theft siren, or the optional 130 dB one, must not be triggered within 30 metres of the ears of a person nearby. The use of hearing protection is strongly recommended.

The electrical installation of the device must be carried out by a recognised professional. Do not attempt to carry out the electrical installation of the GeoRide device yourself if you are not an expert.

GeoRide has received CE and UTAC certification for electronic products. It can therefore be used safely on any vehicle.
