PREAMBLE

This Privacy Policy is addressed to you, (hereinafter “you” or “Users”), user of the website https://georide.com or https://georide.fr (hereinafter “the Site” ) and the GeoRide application (hereinafter “the Application”).

Its purpose is to inform you about the way in which your personal information may be collected and processed by the company KIBLE (hereinafter referred to as “GeoRide”).

Respect for your privacy and your personal data is one of our priorities, which is why we are committed to processing your data in strict compliance with the Data Protection Act of January 6, 1978, as amended by law. No. 2018-493 of June 20, 2018 (hereinafter the “Data Protection Act”) and the General Data Protection Regulation of the Council of Europe of April 27, 2016 (hereinafter the “GDPR”).

The person responsible for data processing carried out via the Site and the Application is the company KIBLE.

The Data Protection Officer's mission is to inform, advise and monitor GeoRide's compliance with the rules relating to the protection of personal data in carrying out the processing operations carried out.

COLLECTION & ORIGIN OF DATA

As part of the operation of its Site and Application, GeoRide collects and processes personal data relating to its Users. This data comes directly from Users.

GeoRide informs you of the purposes for which your data is collected via online data collection forms, emails sent to you or even via our Cookie Management Charter.

CONSENT

The GeoRide GPS box is the flagship product of our brand. We offer a large number of features (journey recording, fall detector, alarm, journey tracking via our community) and the collection of location data is essential for the operation of the Mobile Application which is associated with the product.

Before any collection of location data, GeoRide undertakes to obtain your express consent via the Application. You can of course withdraw your consent at any time via the GeoRide Application.

In this case, your location data will no longer be collected by GeoRide.

Article L.34-IV of the Postal and Electronic Communications Code (CPCE) establishes the principle of prior consent of the person concerned to the use of any geolocation service:

“Without prejudice to the provisions of III and IV and subject to the requirements of legal investigations, the data enabling the location of the user's terminal equipment may neither be used during the communication for purposes other than its routing, nor be retained and processed after completion of the communication only with the consent of the subscriber, duly informed of the categories of data in question, the duration of the processing, its purposes and the fact that these data will or not be transmitted to suppliers third-party services. The subscriber can withdraw his consent at any time and free of charge, apart from the costs linked to the transmission of the withdrawal. The user can suspend the consent given, by a simple and free means, apart from the costs linked to the transmission of this suspension. Any call intended for an emergency service constitutes the user's consent until the completion of the emergency operation it triggers and only to enable it to be carried out. »

When the legal basis used for the processing operations carried out by GeoRide is based on the pursuit of a legitimate interest, the User has the possibility, upon simple request, of obtaining information relating to the balancing of interests.

DATA RECIPIENTS

Within the limits of their respective responsibilities and for the purposes mentioned in article 5, the main people who will be likely to have access to your data are the following:

  • Authorized GeoRide personnel;
  • The authorized personnel of the subcontractors that GeoRide may use as part of its services (telephone operator Twilio; OneSignal);
  • Financial organizations (Banque Populaire) and control bodies;
  • If applicable, the courts concerned, mediators, accountants, auditors, lawyers, bailiffs, collection companies, police or gendarmerie authorities in the event of theft or judicial requisition as well as emergency services.

Your personal data is not communicated, exchanged, sold or rented without your express prior consent in accordance with applicable legal and regulatory provisions.

DATA RETENTION DURATION

Your data is kept only as long as necessary for the purposes pursued as described in article 5.

They may be kept for a longer period, in particular for evidentiary purposes, in compliance with the requirements of the GDPR and the applicable legal provisions, it being specified that you can object to the processing of your personal data at any time.

For the management of our commercial relations

The data used as part of the management of the commercial relationship with our Clients is kept for the entire period necessary for the execution of the contract, and for 3 years from the end of the commercial relationship for commercial prospecting purposes.

This data is then archived for a period of 5 years for evidentiary purposes .

Location data

– For the fight against theft: the data is kept for the duration of the investigation of the case by the competent judicial authorities

– For the fall detector: the location data is only reported once the call is triggered and is deleted at the end of the phone call.

– For recording journeys: the data is kept locally for a period defined by the User. In any case, location data cannot be kept for a period of more than 3 years.

TRANSFER OUTSIDE THE EUROPEAN UNION

GeoRide transfers your personal data to its subcontractor located in the United States as part of the management of calls triggered via the GeoRide box, push notifications and hosting services.

GeoRide ensures that the confidentiality and security of your data is respected by putting in place appropriate guarantees, in particular under Article 46, paragraph 2 of the GDPR.

DATA SECURITY

GeoRide and its possible subcontractors undertake to implement all technical and organizational measures to ensure the security of the processing of personal data and the confidentiality of your data, in application of the Data Protection Act and the GDPR.

As such, GeoRide takes the necessary precautions, taking into account the nature of your data and the risks presented by our processing, to preserve the security of the data and, in particular, to prevent them from being distorted, damaged, or from third parties not authorized to have access to it (physical protection of premises, authentication process for our customers with personal and secure access via confidential identifiers and passwords, logging of connections, encryption of certain data, pentest, etc.).
