General Terms of Use

GeoRide's liability

GeoRide undertakes to use its best efforts to provide the Services diligently and in accordance with best practice, it being specified that it is bound by an obligation of means, to the exclusion of any obligation of result, which the user expressly acknowledges and accepts.

Its liability is strictly limited to the provision of the services under the terms described herein, to the exclusion of any other service. The User further acknowledges and accepts that the services are provided as is, without any warranty of any kind, express or implied.

In particular, GeoRide does not warrant that:

  • the Services, the product and the application, which are the subject of constant research aimed in particular at improving their performance and development, will be entirely free of errors, faults or defects;
  • the Services, which are standard and in no way offered solely for the User on the basis of their own personal requirements, will specifically meet the User's needs and expectations;
  • the application will operate without interruption, GeoRide reserving the right to temporarily suspend access to the Application for maintenance reasons, and in no event being liable for disruptions or failures of the internet or telecommunications network or the availability of GeoRide's servers, and more generally for anything originating in circumstances beyond its control or resulting from force majeure;
  • the GPS positioning of the product and the application, or its effectiveness, since it is provided « as is » by a subcontractor and without any warranty of any kind.
  • The crash detection of the product and the application will operate without interruption, GeoRide not being liable for disruptions or failures of the internet or telecommunications network, GSM, GPS, or the availability of GeoRide's servers.
  • The connected alarm of the product and the application will operate without interruption, GeoRide not being liable for disruptions or failures of the internet or telecommunications network, GSM, GPS, or the availability of GeoRide's servers.

The User acknowledges and accepts that GeoRide furthermore cannot be held liable if performance of the services is incomplete and/or impossible in the following cases:

  • if the User refuses to give GeoRide access to notification delivery or to the contact list, which are essential to the proper functioning of the Service;
  • where the User's mobile phone is damaged at the time the services are performed, for any reason whatsoever, in conditions making performance of said Services impossible or partially impossible;
  • if the Application does not work on the User's mobile phone, for any reason whatsoever.

GeoRide cannot be held liable in the event of:

  • Damage to the vehicle and its parts or to the GeoRide tracker resulting from incorrect installation or any use not in accordance with the instructions contained in the user guide available in the application.
  • Injury, burns or any other bodily harm caused during installation if the safety measures set out in the installation guide were not followed.
  • An accident while the tracker is in operation if the safety warnings were not followed.

2-Year Limited Warranty on the GeoRide tracker

GeoRide's two-year limited warranty is a commercial warranty offered by the manufacturer. It confers rights that are separate from those you may have under the law. The warranty therefore adds to the rights conferred by law, rather than replacing them, as described below.

Rights granted by the statutory warranty

GeoRide is in all cases responsible for the applicable statutory warranty and, in particular, GeoRide is liable for any lack of conformity as provided in Articles L. 211-4 et seq. and for any hidden defect as provided in Articles 1641 et seq. of the French Civil Code.

Regarding the conformity warranty under Article L. 211-4 of the French Consumer Code: « The seller must deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation where the latter was made the seller's responsibility under the contract or was carried out under the seller's responsibility. »

Under Article L. 211-5 of the French Consumer Code: « To conform to the contract, the goods must:

1° Be fit for the purpose usually expected of similar goods and, where applicable:

  • match the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model;
  • have the qualities that a buyer may legitimately expect in view of the public statements made by the seller, by the manufacturer or by its representative, particularly in advertising or labelling;

2° Or have the characteristics defined by mutual agreement between the parties or be fit for any special purpose sought by the buyer, made known to the seller and accepted by the latter. »

Article L. 211-12 of the French Consumer Code: « Action resulting from a lack of conformity lapses two years after delivery of the goods. »

Article L211-16 of the French Consumer Code: « Where the buyer asks the seller, during the course of the commercial warranty granted at the time of the purchase or repair of movable goods, for a repair covered by the warranty, any period during which the goods are out of service for at least seven days is added to the remaining duration of the warranty. That period runs from the buyer's request for service or from the time the goods in question are made available for repair, if that occurs after the request for service. »

Concerning the warranty against hidden defects, under Article 1641 of the French Civil Code: « The seller is bound by a warranty against hidden defects in the item sold that render it unfit for its intended use, or that so impair that use that the buyer would not have purchased it, or would have paid a lower price for it, had they known of them. » Under Article 1648, first paragraph, of the French Civil Code: « Action resulting from redhibitory defects must be brought by the buyer within two years of discovery of the defect. »

What does this warranty cover?

GeoRide warrants the brand's hardware products and accessories contained in their original packaging against defects in materials and workmanship when used in accordance with the user manuals.

Please note: all warranty claims will be handled in accordance with the provisions set out in this warranty document.

What does this warranty not cover?

This warranty does not apply:

  • (a) to consumable parts, such as batteries or protective coatings designed to wear over time, unless the damage is due to a defect in materials or workmanship;
  • (b) to cosmetic damage, including but not limited to scratches, dents or broken plastic on ports, unless the damage is due to a defect in materials or workmanship;
  • (c) to damage caused by use with a third-party component or product that does not meet the product's specifications;
  • (d) to damage caused by an accident, abuse, misuse, exposure to liquid, fire, earthquake or any other external cause;
  • (e) to damage caused by use of the product not in accordance with the guidelines set out in the user guide;
  • (f) to damage caused by any work (including upgrades and extensions) carried out by anyone who is not a member of GeoRide's staff;
  • (g) to a product that has been modified to alter its functionality or capabilities without GeoRide's written permission;
  • (h) to defects resulting from normal wear and tear or the normal ageing of the product.

Your responsibilities

Do not attempt to open the tracker. Opening the product or removing the protective covers may cause damage that is not covered by this warranty. Only the GeoRide team is authorised to carry out repairs on this product.

What GeoRide does in the event of a warranty claim

If, during the warranty period, you submit a claim to GeoRide under this warranty, GeoRide may:

  • repair the product using new parts or used parts that are equivalent to new parts in performance and reliability, or
  • replace the product with the same model (or, with your consent, a product with similar features), made up of new parts and/or refurbished parts of equivalent performance and reliability, or
  • refund the sale price in exchange for the return of your product.

If a part or product is replaced or a refund is granted, any replacement product becomes your property and the refunded or replaced product becomes GeoRide's property.

How to obtain warranty service

To obtain warranty service, please submit a request using the contact form available on the GeoRide website: georide.fr.

GeoRide will send you prepaid shipping labels and, where applicable, packaging materials and instructions explaining how to pack and address your product, so that you can ship it. Once the repair is complete, GeoRide will return the product to you. GeoRide will bear the shipping costs to and from your location provided the instructions regarding the method of packing and shipping the product are followed.

Limitation of liability

Except for the rights granted to you by consumer protection law, as stated at the beginning of this document, all warranties and other terms not set out in this warranty document (whether oral or written) are, to the fullest extent permitted by law, excluded from GeoRide's two-year limited warranty.

In no event shall GeoRide be liable for any of the following:

  • loss of profits;
  • loss of business;
  • loss of goodwill and/or other similar losses;
  • loss of anticipated savings;
  • loss of property;
  • loss of contracts;
  • loss of use;
  • loss of or damage to data or information;
  • any special, indirect, consequential or purely economic damage, loss, expense, charge or cost.

General

No GeoRide reseller, employee or agent is authorised to make any modification, extension or addition to this warranty. If any term is held to be illegal or unenforceable by law, it will be excluded from the warranty and the legality or enforceability of the remaining terms will not be affected.

This warranty is governed by and interpreted in accordance with the laws of the country in which the product was purchased.

The optional 130 dB anti-theft siren is prohibited for use in urban areas or near people. The supplied 110 dB anti-theft siren and the optional 130 dB siren must not be triggered within 30 metres of a nearby person's ears. Wearing hearing protection is strongly recommended.

The electrical installation of the tracker must be carried out by a recognised professional. Do not attempt to carry out the electrical installation of the GeoRide tracker yourself if you are not an expert.

GeoRide has received CE and UTAC certification for electronic products. It can therefore be used safely on any vehicle.
